Terms of Service

The 30-second version
Use the service legitimately, don't share your API keys, don't fake certificates, pay your invoice on time. We don't own your data, you can leave whenever, Dutch law applies. The numbered sections cover the edge cases.
1. Acceptance of terms
By accessing or using CarbonTrace (carbontrace.cloud), you agree to be bound by these Terms of Service. If you are using CarbonTrace on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms. If you do not agree, do not use the service.
2. Service description
CarbonTrace provides carbon footprint calculation, certificate generation, and sustainability reporting tools for IT assets. The service includes a web dashboard, REST API, and related features as described on our website. Features vary by plan (Free, Pro, Business, Enterprise).
3. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized access. One person or organisation may not maintain multiple free accounts.
4. Acceptable use
You may use CarbonTrace for lawful purposes related to carbon footprint calculation and sustainability reporting. You may not: reverse engineer the service, use the API to build a competing product, submit false or misleading data to generate fraudulent certificates, attempt to circumvent rate limits or plan restrictions, or share API keys publicly.
5. Data and calculations
Carbon footprint calculations are based on EU-verified emission factors and established methodologies (PAIA-aligned). While we strive for accuracy, calculations are estimates based on available data and should not be used as the sole basis for regulatory compliance without independent verification. You retain ownership of all data you submit to CarbonTrace.
6. Certificates
CO₂ Impact Certificates generated by CarbonTrace reflect the calculation results at the time of issuance. Certificates include a unique verification number and QR code. Certificates are not third-party audited unless explicitly stated. Misrepresenting certificate scope or origin is a violation of these terms.
7. API usage
API access is subject to rate limits based on your plan. API keys are confidential and must not be shared publicly or embedded in client-side code. We reserve the right to suspend API access for abusive usage patterns. API availability targets are described in our documentation but are not guaranteed SLAs unless covered by an Enterprise agreement.
8. Payment and billing
Paid plans are billed monthly or annually via Mollie. Prices are in EUR and exclusive of VAT where applicable. You can upgrade, downgrade, or cancel at any time. Refunds are handled on a case-by-case basis. Free plan users may be subject to usage limits as described on the pricing page.
9. Intellectual property
CarbonTrace, its code, design, documentation, and emission factor database are the intellectual property of Simplinity. You may not copy, modify, or redistribute any part of the service without written permission. Your data remains yours — we claim no ownership over data you submit.
10. Limitation of liability
CarbonTrace is provided “as is” without warranty of any kind. To the maximum extent permitted by Dutch law, we shall not be liable for indirect, incidental, special, or consequential damages. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Termination
You may close your account at any time from your settings page. We may suspend or terminate accounts that violate these terms, after reasonable notice where possible. Upon termination, your data will be retained for 30 days to allow export, then permanently deleted.
12. Governing law
These terms are governed by the laws of The Netherlands. Any disputes shall be resolved in the courts of The Netherlands. This does not affect your statutory rights as a consumer in your country of residence within the EU.
13. Changes to these terms
We may update these terms from time to time. We will notify you of material changes at least 30 days in advance via email or in-app announcement. Continued use after changes take effect constitutes acceptance.
